USER AGREEMENT

1) Authorship *

I respect and appreciate the experience, training, expertise, research, and development work that made The HWD App possible. I agree not to copy, duplicate, replicate, imitate, or reverse-engineer it in any way, directly or indirectly.

2) Easy Onboarding *

I recognize that a specialized, adaptable business management tool like this usually necessitates a substantial initial "Onboarding Fee." I appreciate that such is not the case here.

3) Incomparability *

I recognize how because it's adaptable and it measures Contribution Margin in unique ways that help my business in my terms, both its benefits and costs are incomparable.

4) Friendly Terms *

I understand that I am under no long-term obligation to use this application. If it's good, it will prove itself. Terms are month-to-month, at will, for as long as I am satisfied. If at any time I am dissatisfied, I will notify the developer, Economist Kris Freeberg, and give him an opportunity to improve it to my satisfaction. If I remain dissatisfied, I am free to cancel at my convenience, verbally or in writing.

5) Confidentiality *

I appreciate that all of my information stored in the HWD App will be kept confidential.

6) Host & Terms of Service *

I understand that the HWD App is hosted by QuickBase, Inc. which my developer, Mr. Freeberg, does not control. I acknowledge that having been developed by Intuit, maker of the popular QuickBooks accounting software, QuickBase is a reputable, stable, and trustworthy company. Nonetheless, I recognize how sometimes even the best companies experience difficulties now and then, for which I agree to hold Mr. Freeberg harmless. I understand access may be limited from time to time for maintenance and improvements, and that as a registered user, QuickBase, Inc. will inform me directly about such events. I understand that I must respect QuickBase's Terms of Service, which I have read.

7) Spine *

Using a sports analogy, I recognize how The HWD App is to an accounting system as a stat sheet is to a score board: the stat sheet shows how the team is doing while the game is being played, while the score board shows the final outcome after the game is over. Or using a farming analogy, I recognize how it's designed to close the barn door while the horse is still in the barn.

As such, insofar as it recognizes both revenue and expenses earlier than my accounting system does, in better, more detailed Contribution Margin terms than my accounting system can, I recognize how it has the potential to be a new, better, stronger, more nimble and valuable spine for my business.

8) Price, Editions, & Support *

I understand and appreciate that the $199/user/month price that I am agreeing to pay entitles me not only to use the application, but to the following unlimited help:

     - Onboarding (getting my data into it, training staff);

     - Making minor changes and improvements to make it match and support my business situation and processes;

     - Working with me to design and use reports and charts that will help me grow and optimize my business;

     - Re-training staff when I experience turnover; and

     - Any other support that Mr. Freeberg and I may agree is reasonable.

Furthermore, I understand that this price entitles me to use whichever edition of the QuickBase development platform (Essential, Premier, Platform, or Unlimited) is most appropriate for my business. I agree to choose the right edition in consultation with Mr. Freeberg, and to keep him as the Administrator.

I understand as well that within a few months of our working relationship it may make sense to establish my own direct relationship with QuickBase, Inc. by transferring my HWD application into my own QuickBase account or "realm." When that happens, I understand that I will receive a discount from Mr. Freeberg in the amount of the per-user cost that I pay QuickBase Inc., and that I will keep Mr. Freeberg as application administrator.

At such time, I understand that what I pay QuickBase Inc. is for the QuickBase platform, and that what I pay Mr. Freeberg is for development and support of the application that he made for me with it.

9) How many users? (Please remember QuickBase's Terms of Service do not allow concurrent logins or sharing of user accounts.) *
